1Who we are
Marked is a virtual reality application for Meta Horizon devices, developed and published by Jake Phillips, a sole trader based in the United Kingdom ("we", "us", "our"). For the purposes of the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (GDPR), and equivalent laws, Jake Phillips is the data controller responsible for your personal data collected through Marked.

2What this policy covers
This policy explains what personal data we collect when you use Marked, why we collect it, who processes it on our behalf, and the rights you have over it. It applies to Marked as distributed through the Meta Horizon Store, including any test, beta, or early-access builds.
Meta Platforms, Inc. and its affiliates ("Meta") separately collect and process data as the operator of your Meta account, your headset, and the Meta Horizon Store. That processing is governed by Meta's own privacy policies, not this one.
3Data we collect

4Data we do not collect
Marked does not collect, transmit, or store:
- Microphone or camera data;
- Eye tracking, body tracking, or face tracking data (Marked does not use these features);
- Your precise location;
- Payment card numbers or billing details (payments are handled entirely by Meta);
- Data for advertising or marketing purposes.
Your headset and hand positions are used on your device to render the game and, in multiplayer, are shared with your session as described in section 3. They are never recorded, stored, or used for any other purpose.
5How and why we use your data
We use the data described above only to operate Marked:
- To provide your game account and save your progress — signing you in, syncing your saves and inventory across sessions and devices, and running server-side game logic. Legal basis: performance of a contract (Article 6(1)(b) UK GDPR).
- To run multiplayer sessions — transmitting your avatar's movements and display name to the other players in your session so you can play together. Legal basis: performance of a contract (Article 6(1)(b) UK GDPR).
- To deliver purchased content — verifying your entitlements with Meta and granting the corresponding in-game content. Legal basis: performance of a contract (Article 6(1)(b) UK GDPR).
- To respond to support requests and legal obligations — answering your emails, handling data-rights requests, and complying with applicable law. Legal basis: legitimate interests (Article 6(1)(f)) and legal obligation (Article 6(1)(c)).
We do not sell your personal data, use it for advertising, or share it with third parties except as described in this policy.
6Service providers we use
We use Unity Technologies ("Unity") as a data processor. Unity Gaming Services provides the backend infrastructure for Marked, specifically:
- Unity Authentication — creating and signing in to your game account using your Meta identifier;
- Unity Cloud Save — storing your game save data;
- Unity Cloud Code — running server-side game logic;
- Unity Economy — managing your virtual currency and in-game inventory.
Unity processes this data solely on our behalf and under our instructions, subject to Unity's Data Processing Addendum. Unity relies on sub-processors, principally Google Cloud Platform and Amazon Web Services, to host these services. You can read more in Unity's Player Privacy Policy and Unity's sub-processor list.
We also use Photon (Exit Games GmbH, Germany) as a data processor. Photon operates the real-time multiplayer network for Marked: when you play with others, your multiplayer session data (avatar movement, game actions, and your display name) is relayed through Photon's servers to the other players in your session. Photon processes this data on our behalf solely to operate your multiplayer session. You can read more in Photon's privacy policy.
7Where your data is processed
Depending on the service, Unity and its sub-processors may process your data in some or all of the following countries: Australia, Belgium, Brazil, Germany, Singapore, Taiwan, and the United States of America.
Multiplayer session data is relayed through the Photon server region that offers the best connection for the players in your session. Photon operates relay servers in multiple regions worldwide, so this may include regions outside the United Kingdom and the European Economic Area.
Where personal data is transferred outside the United Kingdom or the European Economic Area, those transfers are protected by appropriate safeguards, including the UK International Data Transfer Addendum and the European Commission's Standard Contractual Clauses, as incorporated into our processors' data processing terms.
8Purchases
In-app purchases in Marked are made through the Meta Horizon platform. Meta processes your payment and billing information under its own terms and privacy policy. We receive only confirmation of the entitlements you own, which we use to grant you the corresponding in-game content and record it in your in-game inventory.
9How long we keep your data
We keep your account, save, and economy data for as long as you have a game account with Marked, so that your progress and purchases remain available to you. Multiplayer session data is relayed in real time and is not stored by us. If you ask us to delete your data, or if the game is discontinued, we will delete it, except where a longer retention period is required by law. Support correspondence is kept for as long as reasonably necessary to handle your request and for record-keeping.
10Your rights
Under the UK GDPR and the GDPR you have the right to:
- Access the personal data we hold about you;
- Rectify inaccurate personal data;
- Erase your personal data ("right to be forgotten");
- Restrict or object to certain processing;
- Data portability — receive your data in a structured, machine-readable format;
- Complain to a supervisory authority.
To exercise any of these rights, including deletion of your game account and all associated data, email us at riggedingame@gmail.com from an address you can be contacted at, telling us your Meta display name or user ID so we can locate your data. We will respond within one month.
If you are in the UK, you may complain to the Information Commissioner's Office (ICO) at ico.org.uk. If you are in the EU/EEA, you may complain to your local data protection authority.
11Children
Marked is not directed at children. Use of Marked requires a Meta account, and users must meet Meta's minimum age requirements for the Meta Horizon platform in their country. We do not knowingly collect personal data from children below the age at which they can consent to data processing in their country. If you believe a child has provided us with personal data, contact us at riggedingame@gmail.com and we will delete it.
12Security
Your data is stored and transmitted using the security measures of Unity Gaming Services, Photon, and their cloud infrastructure providers, including encryption in transit. Access to backend data is limited to the developer. No system can be guaranteed to be completely secure, but we take reasonable technical and organisational measures to protect your data.
13Changes to this policy
We may update this policy as Marked develops — for example, if we add new features or service providers. When we do, we will update the effective date at the top of this page, and where changes are significant we will provide notice within the app or on its store page. The current version will always be available at this address.
